This Emile & Solange online website, www.emileandsolange.com is a shopping website where you can browse, select and order products advertised on the website from Emile & Solange PTY LTD (ABN 31 613 316 957) ("Emile & Solange", "us" or "we").

 

YOUR AGREEMENT TO THE TERMS AND CONDITIONS

The terms and conditions below apply to all orders placed using our website and any orders placed with customer services by telephone. Please read them carefully before placing your order.
While we make reasonable efforts to provide accurate and timely information, you should not assume that the information provided is always up to date or that this website contains all the relevant information available about Emile & Solange. We are not responsible for typographical errors.

 

OUR PRIVACY POLICY

We collect personal information when you register with us at www.emileandsolange.com, or when you make a purchase from our website or by phone. The information is used to enable us to process and deliver orders that you may place. By registering your details on our website, you agree to our recording, holding, maintaining and using personal data that you supply.

However, we wish to reassure you that we never give, sell, or swap our list of customers with anyone else. But, if you wish to have your details removed from our database, please email us, and we shall remove them.

ORDERING

PLACING AN ORDER FOR PRODUCTS

You place an order when you are selecting and submitting your Order through the website www.emileandsolange.com

You agree to provide us with current, complete and accurate details when asked to do so by the website.

 

ACCEPTANCE OR REJECTION OF AN ORDER

We reserve the right to accept or reject your Order for any reason, including if the requested Product is not available, if there is an error in the price or the product description posted on the website or an error in your Order.

If we reject an Order placed through the website, then we will endeavour to notify you of that rejection at the time you place the Order or within a reasonable time after you submit your Order.

 

SUBSTITUTION POLICY

We reserve the right to substitute an item with another item of equal or greater value than the original, or issue a refund for the product. In these circumstances, we will make every effort to ensure that the style and quality of the substitution is as similar to the original item as possible.

We may also select a replacement item, if we believe it is in keeping with a particular theme of one of our selection boxes.

In instances where we believe we must make a substitution, we will make every effort to notify you of this ahead of time. If you elect not to receive a substitute product you will need to advise us at anytime of placing your order.

 

DELIVERY OF PRODUCTS

We will only deliver Products ordered through the website to a location where we provide delivery services.

We can deliver to your home or place of work, and to the home or work-place of your relatives, friends, colleagues or business associates. We must have a complete post code, address and telephone number for every delivery address. 

Because most of our products are perishable, we must have an alternative delivery instruction for any private address, such as "leave in porch/on step/with a neighbour". This is particularly important if you are sending a surprise gift.

If you are not home and did not leave any instruction, we will deliver the Products to the front door at the relevant Delivery Address.

In any case, you are responsible for all loss or damage suffered by us in connection with our delivery of the Products once the Products have been delivered at the Delivery Address.

You may contact us to arrange for delivery at a different time, and we may charge you an additional Delivery Fee for that replacement delivery.

 

CANCELLING YOUR ORDER

We may cancel any Order or part of an Order (including any Orders that we have accepted) without any liability to you for that cancellation at any time if:

-       the requested Products in that Order are not available;

We will provide you with reasonable notice of that cancellation, and will not charge you for the cancelled Order. If any payment has been taken for the cancelled Order, then the full payment amount, including any Delivery Fee and other fees and charges, will be refunded to your original payment method or through an alternative means

-       there is an error in the price or the product description posted on the website in relation to the relevant Product in that Order

You may cancel an Order (whether it is accepted by us or not) by contacting us via email sarah@emileandsolange.com. In this instance, if you cancel an Order that has been accepted by us:

-       before the day of delivery or collection, then no fees or charges will apply to that cancellation

If you cancel an Order in respect of which we have taken payment, then the full payment amount, including any Delivery Fee will be refunded to your original payment method or through an alternative means.

-       on the day of delivery or collection, then we may charge you a cancellation fee of the value of any perishable Products that were ordered

-       if the order has been already dispatched, your order cannot be countermanded.

 

MISSING ITEMS IN DELIVERY

If there are items missing from your delivery or collection, then you should check the receipt that we provided to you to determine if the missing Product is marked as out of stock. If so, then you may contact us at sarah@emileandsolange.com within 24 hours after the delivery or collection time and we will take steps to verify and confirm any such missing items. Once we are reasonably satisfied that the item was not delivered to you, provide you with a credit to your relevant card account within 3-5 business days for the Products that were charged but not delivered to you.

 

COMPLAINTS PROCEDURE / REFUND

We make all necessary efforts to offer you quality products and the best service that could possibly be.

However, if you are unhappy with the condition of any of your goods, for any reason, or if you receive a damaged packet, please let us know immediately about the problem at the following address sarah@emileandsolange.com

If you do not let us know of a problem within 2 days of having received an order, we would not feel obliged to accept your claim.

 

PAYMENT METHOD

You must pay the fees and charges online using the online payment methods.

If we are unable to successfully process your payment for your Order that is accepted by us, then we may notify you of dishonour and cancel your Order.

You authorise Emile & Solange to debit the amount that is payable for an accepted Order from your nominated credit card to pay for the fees and charges.

You must not pay, or attempt to pay, for Products through any fraudulent or unlawful means.

 

COPYRIGHT AND TRADEMARK

All copyright, database rights, trademarks and all other intellectual property rights in the content of this website, such as texts, graphics, logos, banners, images, are the sole property of Emile & Solange. Any use (including copying, reproduction, duplication, transmission and display of the content of this website), without the express written permission of Emile & Solange is strictly prohibited.

 

WAIVER

If you breach our Terms and Conditions, and we take no action with regard to that breach, we shall still be entitled to use our rights and remedies in other situations where you are in breach.

 

GOVERNING LAW

These Terms and Conditions are governed by and written in accordance with the laws of the State of Queensland. Any dispute arising from transactions and/or these terms shall be resolved exclusively in the state and federal courts of the State of Queensland.
